Thalatha is a platform that connects clients with home service providers through video-based requests. Our Service allows:

  • Clients to upload videos describing their home service needs
  • Service providers to view requests and submit quotes
  • Facilitation of communication between clients and service providers
  • Payment processing for completed services
  • Review and rating systems for quality assurance

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Verification

We may require phone number verification through SMS to ensure account security and prevent fraud. You agree to provide accurate contact information and respond to verification requests.

3.3 Account Security

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Responsibilities

4.1 Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

5.2 Payment Terms

Service providers will receive payment for completed services, minus applicable platform fees. Payment processing times may vary based on payment method and service provider location.

5.3 Service Provider Responsibilities

Service Providers are responsible for their own taxes, insurance, and compliance with local regulations. Thalatha acts as a platform facilitator and is not responsible for service provider business operations.

6. Payment Terms

6.1 Payment Processing

All payments are processed securely through third-party payment processors. We accept major credit cards, debit cards, and other payment methods as available in your region.

6.2 Pricing and Fees

Service pricing is determined by service providers. We may charge platform fees for facilitating transactions. All fees will be clearly disclosed before payment.

6.3 Refunds

Refund policies vary by service type and service provider. Generally, refunds may be available for services not completed as agreed. Refund requests must be submitted within 48 hours of service completion.

7. Intellectual Property

7.1 Our Content

The Service and its original content, features, and functionality are owned by Thalatha and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

You retain ownership of content you upload to our Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with our Service.

7.3 Copyright Policy

We respect intellectual property rights and will respond to valid copyright infringement claims. If you believe your copyright has been infringed, please contact us at legal@thalatha.app.

8. Privacy and Data Protection

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and data, though some information may be retained for legal or regulatory purposes.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the quality, safety, or legality of services provided by third-party service providers.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THALATHA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any damages arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Thalatha and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Kuwait, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Kuwait City, Kuwait.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service and may delete your account.
